Insult to injury in the multi-modal mecca

The cyclist who was hospitalized after a crunch with a Tri-Met bus on the Portland transit mall on August 12 was given a ticket for failing to obey a traffic device in the incident, according to the BikePortland blog. [Via KGW.]

So the bus had it's yield flasher going, and the bike didn't. 23 ton bus > 0.1 ton man + bike.

A bicyclist didn't obey a traffic device?!! I am shocked, I tell you, shocked!

The irony here is:

1. CoP is short on money
2. Bike riders are notorious scofflaws
3. A "bicycle safety initiative" ticketing bicycles would bring in tons of traffic revenue
4. Sam Adams would never allow such a thing to occur

Some bicylist is going to have to do something really stupid and die a grisly death in front of TV cameras before CoP would crack down

This can not be allowed to stand. It will not be allowed to stand. A pro bono attorney shall fight for the rights of this, this, ...creature and Portland progress shall again flow forth unvexed to
the sea.

Don't worry, the BTA's on the case as we speak, lining up the attorneys among its membership to get the biker exonerated and the bus driver sued.

The investigation found the biker at fault, just like it would any other driver, and the biker seems to have honestly admitted his brakes were bad, causing him to fail to yield. This still appears insufficient to many who want to fuel a controversy that, in this instance, apparently doesn't exist. If he tried to pass while the bus was turning, he's at fault. If he was riding around in traffic knowing he had faulty brakes, and that was the reason for the collision, he's at fault. End of story. Just glad the guy wasn't hurt to badly.

Wasn't there a rumor that another biker punched the bus driver? Whatever happened with that? With no followup, I was going to assume it was just that, a rumor, but given the rabid, kneejerk defense bikers mount when one of their herd is wounded I wasn't ready yet to dismiss it entirely.
