Many companies subject to a Prop 65 complaint would prefer to have the State of California bring the suit, rather than be forced into settling with a private plaintiff (or defending a lawsuit brought by a citizen "attorney general"). At least the State is likely to consider defenses. It is quite possible the State chose to take on this suit (taking it away from the private plaintiff) in order to limit the exposure of Whole Foods and others.
